Article 311-9 of the French Cinema and Moving Image Code

The initial contribution gives rise to the conclusion of a contract with the delegated production company before the end of the shooting or before the end of the production of the animation for works belonging to the animation genre or before the start of editing for works composed entirely of pre-existing images. However, where the contract has not yet been concluded, the initial contribution may, on a provisional basis, give rise to a firm and manifest commitment by the publisher(s).
The contribution from a publisher of on-demand audiovisual media services is made in cash in the form of the purchase of rights to make the work available to the public. The duration of the exploitation rights on each on-demand audiovisual media service does not exceed, for all or part of the territories for which these rights have been acquired, seventy-two months, including thirty-six months on an exclusive basis or, where applicable, the duration of the rights provided for in the agreement pursuant to 7° of article 26 of decree no. 2021-793 of 22 June 2021 relating to on-demand audiovisual media services.
For automatic support, the initial contribution must be at least equal to 25% of the final cost of the work or 25% of the French participation in the case of an international co-production, and must include a minimum cash contribution of €12,000 per hour for works in the fiction, animation and creative documentary genres and €20,000 per hour for works in the audiovisual adaptation of a live performance genre.
In order to benefit from selective aid, the contribution may be less than 25% and the minimum cash share is not required.
For the purposes of this chapter, French participation includes all French and foreign financing provided by the delegated production company or other production companies established in France, excluding financing provided by the co-producer(s) established abroad and taking into account the stipulations of the co-production contract.

L’apport initial donne lieu à la conclusion d’un contrat avec l’entreprise de production déléguée avant la fin des prises de vues ou avant la fin de la fabrication de l’animation pour les œuvres appartenant au genre animation ou avant le début du montage pour les œuvres intégralement composées d’images préexistantes. Toutefois, lorsque le contrat n’a pas encore été conclu, l’apport initial peut, à titre provisoire, donner lieu à un engagement ferme et manifeste du ou des éditeurs.
L’apport provenant d’un éditeur de services de médias audiovisuels à la demande est réalisé en numéraire sous forme d’achat de droits de mise à disposition du public de l’œuvre. La durée des droits d’exploitation sur chaque service de médias audiovisuels à la demande n’excède pas, pour tout ou partie des territoires sur lesquels ces droits ont été acquis, soixante-douze mois dont trente-six mois à titre exclusif ou, le cas échéant, la durée des droits prévue par la convention en application du 7° de l’article 26 du décret n° 2021-793 du 22 juin 2021 relatif aux services de médias audiovisuels à la demande.
Pour le bénéfice des aides automatiques, l’apport initial doit être au moins égal à 25 % du coût définitif de l’œuvre ou à 25 % de la participation française en cas de coproduction internationale et comporter une part minimale en numéraire dont le montant horaire est fixé à 12 000 € pour les œuvres appartenant aux genres fiction, animation et documentaire de création et à 20 000 € pour les œuvres appartenant au genre adaptation audiovisuelle de spectacle vivant.
Pour le bénéfice des aides sélectives, l’apport peut être inférieur à 25 % et la part minimale en numéraire n’est pas requise.
Pour l’application du présent chapitre, la participation française comprend l’ensemble des financements français et étrangers apportés par l’entreprise de production déléguée ou les autres entreprises de production établies en France, à l’exclusion des financements apportés par le ou les coproducteurs établis à l’étranger et compte tenu des stipulations du contrat de coproduction.
