Article 321 of the French Code of civil procedure

The oath is taken by the party in person and at the hearing.

If the party proves that he is unable to travel, the oath may be taken either before a judge appointed for the purpose who shall travel, assisted by the court clerk, to the party’s place of residence, or before the court of the party’s place of residence.

In all cases, the oath is made in the presence of the other party or the latter called.

Le serment est fait par la partie en personne et à l’audience.

Si la partie justifie qu’elle est dans l’impossibilité de se déplacer, le serment peut être prêté soit devant un juge commis à cet effet qui se transporte, assisté du greffier, chez la partie, soit devant le tribunal du lieu de sa résidence.

Dans tous les cas, le serment est fait en présence de l’autre partie ou celle-ci appelée.
