Article 347 of the French Code of Criminal Procedure

The President declares the debates closed.

He may not summarise the pleas of the prosecution and the defence.

He orders that the record of the proceedings be deposited in the hands of the clerk of the assize court; however, he retains for the deliberation provided for in the articles 355 et seq, the committal decision and, in the event of an appeal, the judgment handed down by the assize court that ruled at first instance together with the accompanying statement of reasons.

If, in the course of the deliberations, the Assize Court deems it necessary to examine one or more exhibits in the proceedings, the President shall order the file to be transported to the deliberation room, which, for these purposes, shall be reopened in the presence of the Public Prosecutor and the lawyers for the accused and the civil party.

Il ne peut résumer les moyens de l’accusation et de la défense.

Il ordonne que le dossier de la procédure soit déposé entre les mains du greffier de la cour d’assises ; toutefois, il conserve en vue de la délibération prévue par les articles 355 et suivants, la décision de renvoi et, en cas d’appel, l’arrêt rendu par la cour d’assises ayant statué en premier ressort ainsi que la feuille de motivation qui l’accompagne.

Si, au cours de la délibération, la cour d’assises estime nécessaire l’examen d’une ou plusieurs pièces de la procédure, le président ordonne le transport dans la salle des délibérations du dossier, qui, à ces fins sera rouvert en présence du ministère public et des avocats de l’accusé et de la partie civile.
