Article 353 of the French Civil Code

In the case of the adoption of a ward of the State or a foreign child who is not the child of the adopter’s spouse, partner bound by a civil solidarity pact or cohabiting partner, the court shall check before granting the adoption that the applicant or applicants have obtained approval to adopt or were exempt from obtaining approval.

If approval has been refused or has not been granted within the legal time limit, the court may order the adoption if it considers that the applicant(s) are suitable to receive the child and that the adoption is in the child’s best interests.

Dans le cas d’adoption d’un pupille de l’Etat ou d’un enfant étranger qui n’est pas l’enfant du conjoint, du partenaire lié par un pacte civil de solidarité ou du concubin de l’adoptant, le tribunal vérifie avant de prononcer l’adoption que le ou les requérants ont obtenu l’agrément pour adopter ou en étaient dispensés.

Si l’agrément a été refusé ou s’il n’a pas été délivré dans le délai légal, le tribunal peut prononcer l’adoption s’il estime que le ou les requérants sont aptes à accueillir l’enfant et que celle-ci est conforme à son intérêt.
