Article 361 of the French Civil Code

The relationship resulting from simple adoption extends to the adopted person’s children.

Marriage is prohibited:

1° Between the adopter, the adopted person and their descendants;

2° Between the adopted person and the spouse or partner bound by a civil solidarity pact of the adopter; reciprocally between the adopter and the spouse or partner bound by a civil solidarity pact of the adopted person;

3° Between the adopted children of the same adopter;

4° Between the adopted person and the children of the adopter.

However, the prohibitions on marriage laid down in 3° and 4° above may be lifted by dispensation of the President of the Republic, if there are serious causes.

The prohibition on marriage laid down in 2° above may be lifted under the same conditions where the person who created the alliance or who was bound by a civil solidarity pact has died.

Article 361

Le lien de parenté résultant de l’adoption simple s’étend aux enfants de l’adopté.

Le mariage est prohibé :

1° Entre l’adoptant, l’adopté et ses descendants ;

2° Entre l’adopté et le conjoint ou le partenaire lié par un pacte civil de solidarité de l’adoptant ; réciproquement entre l’adoptant et le conjoint ou le partenaire lié par un pacte civil de solidarité de l’adopté ;

3° Entre les enfants adoptifs du même adoptant ;

4° Entre l’adopté et les enfants de l’adoptant.

Néanmoins, les prohibitions au mariage portées aux 3° et 4° ci-dessus peuvent être levées par dispense du Président de la République, s’il y a des causes graves.

La prohibition au mariage portée au 2° ci-dessus peut être levée dans les mêmes conditions lorsque la personne qui a créé l’alliance ou qui était liée par un pacte civil de solidarité est décédée.
