Article 370-1-3 of the French Civil Code

The full adoption of the child of a spouse, partner bound by a civil solidarity pact or cohabitee is permitted:

1° Where the child has legally established filiation only in respect of that spouse, partner bound by a civil solidarity pact or cohabitee;

2° Where the child has been the subject of a full adoption by that spouse, partner bound by a civil solidarity pact or cohabitee alone and has legally established filiation only in respect of that spouse, partner bound by a civil solidarity pact or cohabitee;

3° Where the parent other than the spouse, partner linked by a civil solidarity pact or cohabitee has had parental authority completely withdrawn;

4° Where the parent other than the spouse, partner linked by a civil solidarity pact or cohabitee is deceased and has left no ascendants in the first degree or where they have manifestly lost interest in the child.

Article 370-1-3

L’adoption plénière de l’enfant du conjoint, du partenaire lié par un pacte civil de solidarité ou du concubin est permise :

1° Lorsque l’enfant n’a de filiation légalement établie qu’à l’égard de ce conjoint, partenaire lié par un pacte civil de solidarité ou concubin ;

2° Lorsque l’enfant a fait l’objet d’une adoption plénière par ce seul conjoint, partenaire lié par un pacte civil de solidarité ou concubin et n’a de filiation établie qu’à son égard ;

3° Lorsque l’autre parent que le conjoint, partenaire lié par un pacte civil de solidarité ou concubin s’est vu retirer totalement l’autorité parentale ;

4° Lorsque l’autre parent que le conjoint, partenaire lié par un pacte civil de solidarité ou concubin est décédé et n’a pas laissé d’ascendants au premier degré ou lorsque ceux-ci se sont manifestement désintéressés de l’enfant.
