Article 373-4 of the French Civil Code

Where the child has been entrusted to a third party, parental authority continues to be exercised by the father and mother; however, the person to whom the child has been entrusted performs all the usual acts relating to the child’s supervision and upbringing.

The family affairs judge, in entrusting the child on a provisional basis to a third party, may decide that he will have to request the opening of a guardianship.

Lorsque l’enfant a été confié à un tiers, l’autorité parentale continue d’être exercée par les père et mère ; toutefois, la personne à qui l’enfant a été confié accomplit tous les actes usuels relatifs à sa surveillance et à son éducation.

Le juge aux affaires familiales, en confiant l’enfant à titre provisoire à un tiers, peut décider qu’il devra requérir l’ouverture d’une tutelle.
