Article 376-1 of the French Civil Code

When a family court is called upon to rule on the terms and conditions of the exercise of parental authority or on the upbringing of a minor child, or when it decides to entrust the child to a third party, it may have regard to any agreements that the father and mother may have freely entered into between themselves on this subject, unless one of them can show serious grounds for revoking his or her consent.

Un juge aux affaires familiales peut, quand il est appelé à statuer sur les modalités de l’exercice de l’autorité parentale ou sur l’éducation d’un enfant mineur ou quand il décide de confier l’enfant à un tiers, avoir égard aux pactes que les père et mère ont pu librement conclure entre eux à ce sujet, à moins que l’un d’eux ne justifie de motifs graves qui l’autoriseraient à révoquer son consentement.
