Article 379-2 of the French Code of Criminal Procedure

The accused absent without valid excuse at the opening of the hearing shall be tried in absentia in accordance with the provisions of this chapter. The same shall apply where the absence of the accused is noted during the proceedings and it is not possible to suspend them until his return.

However, the court may also decide to adjourn the case to a later session, after issuing a warrant for the arrest of the accused if such a warrant has not already been issued.

The provisions of this chapter shall not apply in the cases provided for in the articles 320 and 322. Nor do they apply if the absence of the convicted person during the trial is noted, even though the accused has already been questioned about the facts and his personality; in this case, the trial shall continue until its conclusion, in accordance with Chapters VI and VII of this Title, with the exception of the provisions relating to the presence of the accused, whose lawyer shall continue to defend his interests; if the accused is sentenced to a custodial sentence not covered by pre-trial detention, the court shall issue an arrest warrant for the accused, unless such warrant has already been issued. The time limits for appealing or appealing to the Supreme Court run from the date on which the judgment is brought to the attention of the accused.

Article 379-2

L’accusé absent sans excuse valable à l’ouverture de l’audience est jugé par défaut conformément aux dispositions du présent chapitre. Il en est de même lorsque l’absence de l’accusé est constatée au cours des débats et qu’il n’est pas possible de les suspendre jusqu’à son retour.

Toutefois, la cour peut également décider de renvoyer l’affaire à une session ultérieure, après avoir décerné mandat d’arrêt contre l’accusé si un tel mandat n’a pas déjà été décerné.

Les dispositions du présent chapitre ne sont pas applicables dans les cas prévus par les articles 320 et 322. Elles ne sont pas non plus applicables si l’absence du condamné au cours des débats est constatée alors que les interrogatoires de l’accusé sur les faits et sur sa personnalité ont déjà été réalisés ; dans ce cas, le procès se poursuit jusqu’à son terme, conformément aux chapitres VI et VII du présent titre, à l’exception des dispositions relatives à la présence de l’accusé, son avocat continuant d’assurer la défense de ses intérêts ; si l’accusé est condamné à une peine ferme privative de liberté non couverte par la détention provisoire, la cour décerne mandat d’arrêt contre l’accusé, sauf si ce mandat a déjà été décerné. Les délais d’appel ou de pourvoi en cassation courent à partir de la date à laquelle l’arrêt est porté à la connaissance de l’accusé.
