Article 380-13 of the French Code of Criminal Procedure

Where the appellant is a prisoner, the appeal may be made by means of a declaration to the head of the prison.

This declaration shall be recorded, dated and signed by the head of the penal establishment. It is also signed by the appellant; if the appellant is unable to sign, this is noted by the head of the establishment.

The original or a copy of this document shall be sent without delay to the registry of the Assize Court that handed down the contested decision; it shall be transcribed onto the register provided for in the third paragraph of article 380-12 and appended to the deed drawn up by the court clerk.

Lorsque l’appelant est détenu, l’appel peut être fait au moyen d’une déclaration auprès du chef de l’établissement pénitentiaire.

Cette déclaration est constatée, datée et signée par le chef de l’établissement pénitentiaire. Elle est également signée par l’appelant ; si celui-ci ne peut signer, il en est fait mention par le chef de l’établissement.

Ce document est adressé sans délai, en original ou en copie, au greffe de la cour d’assises qui a rendu la décision attaquée ; il est transcrit sur le registre prévu par le troisième alinéa de l’article 380-12 et annexé à l’acte dressé par le greffier.
