Article 380-16 of the French Code of Criminal Procedure

By way of derogation from Chapters I to V of Subtitle I of this Title, adults accused of a crime punishable by fifteen years or twenty years of criminal imprisonment, when it is not committed in a state of legal recidivism, shall be tried at first instance by the departmental criminal court.

This court shall also have jurisdiction to try related offences.

It shall not have jurisdiction if there are one or more co-defendants who do not meet the conditions laid down in this article.

Par dérogation aux chapitres Ier à V du sous-titre Ier du présent titre, les personnes majeures accusées d’un crime puni de quinze ans ou de vingt ans de réclusion criminelle, lorsqu’il n’est pas commis en état de récidive légale, sont jugées en premier ressort par la cour criminelle départementale.


Cette cour est également compétente pour le jugement des délits connexes.


Elle n’est pas compétente s’il existe un ou plusieurs coaccusés ne répondant pas aux conditions prévues au présent article.
