The departmental criminal court, which sits in the same place as the assize court or, by way of exception and under the conditions set out in article 235, in another judicial court in the same département, is made up of a president and four assessors, chosen by the first president of the court of appeal, in the case of the president, from among the presidents of chambers and councillors in the jurisdiction of the court of appeal who are or have been presiding judges of the assize court and, in the case of the assessors, from among the councillors and judges in this jurisdiction. The first president of the court of appeal may appoint a maximum of two assessors from among magistrates acting in a temporary capacity or honorary magistrates exercising judicial functions under the conditions provided for in the section II of chapter V bis of ordinance no. 58-1270 of 22 December 1958 concerning the organic law on the status of magistrates.
