Article 380-20 of the French Code of Criminal Procedure

If the departmental criminal court considers, during or after the hearings, that the facts before it constitute a crime punishable by thirty years’ imprisonment or life imprisonment, it refers the case to the assize court. If the accused appeared in custody, he shall remain in pre-trial detention until his appearance before the assize court; otherwise, the departmental criminal court may, after hearing the public prosecutor and the parties or their lawyers, issue, by the same decision, a committal order or arrest warrant against the accused.

Si la cour criminelle départementale estime, au cours ou à l’issue des débats, que les faits dont elle est saisie constituent un crime puni de trente ans de réclusion criminelle ou de la réclusion criminelle à perpétuité, elle renvoie l’affaire devant la cour d’assises. Si l’accusé comparaissait détenu, il demeure placé en détention provisoire jusqu’à sa comparution devant la cour d’assises ; dans le cas contraire, la cour criminelle départementale peut, après avoir entendu le ministère public et les parties ou leurs avocats, décerner, par la même décision, mandat de dépôt ou mandat d’arrêt contre l’accusé.
