Article 39-2 of the French Code of Criminal Procedure

As part of his powers in relation to alternatives to prosecution, initiating and exercising public action, directing the criminal investigation police, identity checks and enforcing sentences, the public prosecutor ensures the prevention of breaches of criminal law.

To this end, he leads and coordinates the judicial component of crime prevention policy within the jurisdiction of the judicial court, in accordance with the national guidelines for this policy determined by the State, as specified by the public prosecutor pursuant to Article 35.

It is also consulted by the State representative in the department before the latter adopts the delinquency prevention plan.

Article 39-2

Dans le cadre de ses attributions en matière d’alternative aux poursuites, de mise en mouvement et d’exercice de l’action publique, de direction de la police judiciaire, de contrôle d’identité et d’exécution des peines, le procureur de la République veille à la prévention des infractions à la loi pénale.

A cette fin, il anime et coordonne dans le ressort du tribunal judiciaire la politique de prévention de la délinquance dans sa composante judiciaire, conformément aux orientations nationales de cette politique déterminées par l’Etat, telles que précisées par le procureur général en application de l’article 35.

Il est également consulté par le représentant de l’Etat dans le département avant que ce dernier n’arrête le plan de prévention de la délinquance.
