Article 432 of the French Civil Code

The judge rules, the person being heard or called. The person concerned may be accompanied by a lawyer or, subject to the judge’s agreement, by any other person of his or her choice.

The judge may, however, by specially reasoned decision and on the advice of a doctor on the list referred to in article 431, decide that there is no need to proceed with the hearing of the person concerned if it is likely to harm his health or if he is incapable of expressing his wishes.

Article 432

Le juge statue, la personne entendue ou appelée. L’intéressé peut être accompagné par un avocat ou, sous réserve de l’accord du juge, par toute autre personne de son choix.

Le juge peut toutefois, par décision spécialement motivée et sur avis d’un médecin inscrit sur la liste mentionnée à l’article 431, décider qu’il n’y a pas lieu de procéder à l’audition de l’intéressé si celle-ci est de nature à porter atteinte à sa santé ou s’il est hors d’état d’exprimer sa volonté.
