Article 474 of the French Code of civil procedure

In the event of a plurality of defendants summoned for the same matter, where at least one of them does not appear, the judgment is deemed to be contradictory with regard to all of them if the decision is subject to appeal or if those who do not appear have been summoned in person.

Where the decision is not subject to appeal and at least one of the parties who has not appeared has not been summoned in person, the judgment is rendered by default.

Article 474

En cas de pluralité de défendeurs cités pour le même objet, lorsque l’un au moins d’entre eux ne comparaît pas, le jugement est réputé contradictoire à l’égard de tous si la décision est susceptible d’appel ou si ceux qui ne comparaissent pas ont été cités à personne.

Lorsque la décision n’est pas susceptible d’appel et que l’une au moins des parties qui n’a pas comparu n’a pas été citée à personne, le jugement est rendu par défaut.
