Article 486-1 of the French Code of civil procedure

Where the application for interim relief relates to an investigative measure carried out by a technician or to an expert assessment measure, the defendant who has indicated, before the hearing, that he acquiesces in the application, is exempted from appearing. However, the judge may still order the defendant to appear before him.
The decision rendered under these conditions is contradictory.

Lorsque la demande en référé porte sur une mesure d’instruction exécutée par un technicien ou sur une mesure d’expertise, le défendeur qui a indiqué, avant l’audience, acquiescer à la demande, est dispensé de comparaître. Néanmoins, le juge a toujours la faculté d’ordonner qu’il soit présent devant lui.


La décision rendue dans ces conditions est contradictoire.
