Article 490-1 of the French Code of Criminal Procedure

Where the objector is a prisoner, the objection may be made by means of a declaration to the head of the prison.

This declaration shall be recorded, dated and signed by the head of the prison. It is also signed by the applicant. If the latter is unable to sign, this is noted by the head of the establishment.

This document is sent without delay, in original or copy and by any means, to the public prosecutor at the court that handed down the contested decision.

Lorsque l’opposant est détenu, l’opposition peut être faite au moyen d’une déclaration auprès du chef de l’établissement pénitentiaire.

Cette déclaration est constatée, datée et signée, par le chef de l’établissement pénitentiaire. Elle est également signée par le demandeur. Si celui-ci ne peut signer, il en est fait mention par le chef d’établissement.

Ce document est adressé sans délai, en original ou en copie et par tout moyen, au ministère public près la juridiction qui a rendu la décision attaquée.
