Article 495-1 of the French Code of Criminal Procedure

The public prosecutor who chooses the simplified procedure communicates the prosecution file and his or her submissions to the president of the court.

The president rules without prior discussion by means of a criminal order discharging the offender or sentencing him/her to a fine as well as, where applicable, to one or more of the additional penalties incurred, these penalties being able to be pronounced as the principal penalty. The maximum fine that may be imposed is half the amount of the fine incurred but may not exceed €5,000. The penalties provided for in Articles 131-5 to 131-8-1 of the Penal Code may be imposed; however, community service may only be imposed if the person has declared, during the investigation, that he or she would accept performing such work.

If the judge considers that an adversarial debate is useful or that a prison sentence should be imposed, the judge will refer the case to the public prosecutor.

Le ministère public qui choisit la procédure simplifiée communique au président du tribunal le dossier de la poursuite et ses réquisitions.

Le président statue sans débat préalable par une ordonnance pénale portant relaxe ou condamnation à une amende ainsi que, le cas échéant, à une ou plusieurs des peines complémentaires encourues, ces peines pouvant être prononcées à titre de peine principale. Le montant maximal de l’amende pouvant être prononcée est de la moitié de celui de l’amende encourue sans pouvoir excéder 5 000 €. Les peines prévues aux articles 131-5 à 131-8-1 du code pénal peuvent être prononcées ; la peine de travail d’intérêt général ne peut toutefois être prononcée que si la personne a déclaré, au cours de l’enquête, qu’elle accepterait l’accomplissement d’un tel travail.

S’il estime qu’un débat contradictoire est utile ou qu’une peine d’emprisonnement devrait être prononcée, le juge renvoie le dossier au ministère public.
