Article 495-17 of the French Code of Criminal Procedure

Where provided for by law, public proceedings are extinguished by payment of a fixed fine set by law, which may not exceed the amount provided for in the first paragraph of Article 131-13 of the Penal Code, under the conditions set out in this section.

However, the fixed fine procedure is not applicable if the offence has been committed by a minor or if several offences, at least one of which cannot give rise to a fixed fine, have been recorded simultaneously. Nor does it apply if the offence is a repeat offence, except where the law provides otherwise.

Lorsque la loi le prévoit, l’action publique est éteinte par le paiement d’une amende forfaitaire délictuelle fixée par la loi, qui ne peut excéder le montant prévu au premier alinéa de l’article 131-13 du code pénal, dans les conditions prévues à la présente section.

Toutefois, la procédure de l’amende forfaitaire n’est pas applicable si le délit a été commis par un mineur ou si plusieurs infractions, dont l’une au moins ne peut donner lieu à une amende forfaitaire, ont été constatées simultanément. Elle n’est pas non plus applicable en état de récidive légale, sauf lorsque la loi en dispose autrement.
