Article 495-2-1 of the French Code of Criminal Procedure

Where the victim of the acts has made a claim for damages or restitution in the course of the police investigation as a civil party in accordance with the second paragraph of article 420-1, the President shall rule on this claim in the criminal order. If he is unable to rule on this claim for one of the reasons mentioned in the last paragraph of the same article 420-1, he shall refer the case to the Public Prosecutor’s Office for the purpose of bringing the civil claim before the court. Article 495-5-1 then applies.

Lorsque la victime des faits a formulé au cours de l’enquête de police une demande de dommages et intérêts ou de restitution valant constitution de partie civile conformément au deuxième alinéa de l’article 420-1, le président statue sur cette demande dans l’ordonnance pénale. S’il ne peut statuer sur cette demande pour l’une des raisons mentionnées au dernier alinéa du même article 420-1, il renvoie le dossier au ministère public aux fins de saisir le tribunal sur les intérêts civils. L’article 495-5-1 est alors applicable.
