Article 515-11-1 of the French Civil Code

I.-Where the prohibition provided for in 1° of article 515-11 has been ordered, the family court judge may order a prohibition on approaching the plaintiff at less than a certain distance, which he or she shall determine, and may order, after obtaining the consent of both parties, that each of them wear a mobile electronic anti-approach device enabling them to signal at any time that the defendant is not respecting this distance. In the event of refusal by the defendant to allow this measure to be taken, the family court judge shall immediately notify the public prosecutor.

II.-This system is subject to the processing of personal data, the terms and conditions of implementation of which are defined by decree in the Conseil d’Etat.

I.-Lorsque l’interdiction prévue au 1° de l’article 515-11 a été prononcée, le juge aux affaires familiales peut prononcer une interdiction de se rapprocher de la partie demanderesse à moins d’une certaine distance qu’il fixe et ordonner, après avoir recueilli le consentement des deux parties, le port par chacune d’elles d’un dispositif électronique mobile anti-rapprochement permettant à tout moment de signaler que la partie défenderesse ne respecte pas cette distance. En cas de refus de la partie défenderesse faisant obstacle au prononcé de cette mesure, le juge aux affaires familiales en avise immédiatement le procureur de la République.

II.-Ce dispositif fait l’objet d’un traitement de données à caractère personnel, dont les conditions et les modalités de mise en œuvre sont définies par décret en Conseil d’Etat.
