Article 515-3-1 of the French Civil Code

A mention is made in the margin of each partner’s birth certificate of the declaration of civil solidarity pact, indicating the identity of the other partner. For foreign nationals born abroad, this information is recorded in a register held at the central civil status department of the Ministry of Foreign Affairs. The existence of amending agreements is subject to the same publicity.

The civil solidarity pact does not take effect between the parties until it is registered, which confers a date certain. It may only be relied on as against third parties from the day on which the publicity formalities are completed. The same applies to amending agreements.

Il est fait mention, en marge de l’acte de naissance de chaque partenaire, de la déclaration de pacte civil de solidarité, avec indication de l’identité de l’autre partenaire. Pour les personnes de nationalité étrangère nées à l’étranger, cette information est portée sur un registre tenu au service central d’état civil du ministère des affaires étrangères. L’existence de conventions modificatives est soumise à la même publicité.

Le pacte civil de solidarité ne prend effet entre les parties qu’à compter de son enregistrement, qui lui confère date certaine. Il n’est opposable aux tiers qu’à compter du jour où les formalités de publicité sont accomplies. Il en va de même des conventions modificatives.
