The works are marked with two hallmarks: the maker’s hallmark and the title hallmark, known as the guarantee hallmark.
The maker’s hallmark is in the form of a diamond containing an initial letter of his name and the symbol chosen by him. It may be engraved by such artist as he pleases to choose.
The guarantee hallmark is affixed:
a. Either by the customs and excise authorities;
b. Or by an approved inspection body under the conditions set out in II of Article 535;
c. Or by professionals authorised by an agreement concluded with the customs and indirect rights administration under the conditions provided for in the second paragraph of I of article 535.
The form of the hallmarks and the conditions under which they are affixed are laid down by decree.
The guarantee assures the purchaser, through the affixing of the guarantee hallmark, of the title of the product placed on the market. It is implemented by the administration or by the approved inspection body by means of a prior inspection. When professionals benefit from the authorisation provided for in the second paragraph of I of article 535, they are responsible for the concordance between the title corresponding to the hallmark inscribed and the actual title of the work placed on the market (1).
