Article 525 of the French Code of Criminal Procedure

The public prosecutor who chooses the simplified procedure communicates the prosecution file and his or her submissions to the competent judge of the police court.

The judge rules without prior debate by a criminal order either acquitting the accused or sentencing him or her to a fine and, where applicable, to one or more of the additional penalties incurred.

If he or she considers that an adversarial debate is useful, the judge returns the file to the public prosecutor for prosecution in the forms of ordinary procedure.

Le ministère public qui choisit la procédure simplifiée communique au juge compétent du tribunal de police le dossier de la poursuite et ses réquisitions.

Le juge statue sans débat préalable par une ordonnance pénale portant soit relaxe, soit condamnation à une amende ainsi que, le cas échéant, à une ou plusieurs des peines complémentaires encourues.

S’il estime qu’un débat contradictoire est utile, le juge renvoie le dossier au ministère public aux fins de poursuite dans les formes de la procédure ordinaire.
