Article 527 of the French Code of Criminal Procedure

The Public Prosecutor may, within ten days of the order, lodge an objection to its enforcement by declaration at the court registry.

If, on expiry of the period provided for in the previous paragraph, the Public Prosecutor has not lodged an objection, the criminal order shall be notified to the accused in the manner provided for in the second paragraph of article 495-3 and enforced in accordance with the rules provided for by this code for the enforcement of police judgments.

The accused may, within a period of thirty days from the date on which the letter was sent or from the date on which the public prosecutor brought the order to his attention, lodge an objection to its enforcement.

Failing payment or opposition within the above time limit, the fine and the fixed procedural fee are payable.

However, if it is not clear from the notice of receipt that the accused has received the letter of notification, the opposition remains admissible until the expiry of a period of thirty days running from the date on which the person concerned became aware, on the one hand, of the sentence, either by an enforcement act or by any other means, and on the other hand, of the time limit and forms of opposition open to him.

The competent public accountant shall stop the recovery upon receipt of the notice of opposition to the penal order drawn up by the clerk’s office.

Le ministère public peut, dans les dix jours de l’ordonnance, former opposition à son exécution par déclaration au greffe du tribunal.

Si, à l’expiration du délai prévu à l’alinéa précédent, le ministère public n’a pas fait opposition, l’ordonnance pénale est notifiée au prévenu selon les modalités prévues au deuxième alinéa de l’article 495-3 et exécutée suivant les règles prévues par le présent code pour l’exécution des jugements de police.

Le prévenu peut, dans un délai de trente jours à compter de la date d’envoi de la lettre ou de la date à laquelle le procureur de la République a porté l’ordonnance à sa connaissance, former opposition à l’exécution de celle-ci.

A défaut de paiement ou d’opposition dans le délai ci-dessus, l’amende et le droit fixe de procédure sont exigibles.

Toutefois, s’il ne résulte pas de l’avis de réception que le prévenu a reçu la lettre de notification, l’opposition reste recevable jusqu’à l’expiration d’un délai de trente jours qui courent de la date à laquelle l’intéressé a eu connaissance, d’une part, de la condamnation, soit par un acte d’exécution, soit par tout autre moyen, d’autre part, du délai et des formes de l’opposition qui lui est ouverte.

Le comptable public compétent arrête le recouvrement dès réception de l’avis d’opposition à l’ordonnance pénale établi par le greffe.
