When the fixed fine notice concerning one of the offences mentioned in article L. 121-3 of the Highway Code has been sent to the holder of the registration certificate or to the persons referred to in the last three paragraphs of Article L. 121-2 of this code, the request for exoneration provided for by article 529-2 or the claim provided for by article 530 is only admissible if it is sent by registered letter with acknowledgement of receipt, using the form attached to the fixed fine notice, and if it is accompanied by:
1° Either one of the following documents:
a) A receipt of the complaint lodged for theft or destruction of the vehicle or for the offence of misuse of a number plate as provided for in Article L. 317-4-1 of the Highway Code, or a copy of the declaration of destruction of the vehicle drawn up in accordance with the provisions of the Highway Code;
b) A letter signed by the author of the request or complaint specifying the identity, address and driving licence reference of the person who was presumed to be driving the vehicle when the infringement was recorded;
c) Copies of the declaration of transfer of the vehicle and its acknowledgement of registration in the vehicle registration system;
d) A document certifying, in accordance with the procedures specified by joint order of the ministers responsible for transport, road safety and justice, that an automated driving delegation system was activated in accordance with its conditions of use at the time of the offence.
2° Or a document showing that a prior deposit has been paid in an amount equal to that of the fixed fine in the case provided for in the first paragraph of Article 529-2, or that of the increased fixed fine in the case provided for in the second paragraph of Article 530 ; this deposit is not equivalent to payment of the fixed fine and does not give rise to the withdrawal of driving licence points provided for in the fourth paragraph of article L. 223-1 of the Highway Code.
The officer of the Public Prosecutor’s Office shall check whether the conditions for admissibility of the request or complaint provided for in this article have been met.
The requests and claims provided for in this article may also be sent electronically, in accordance with the procedures specified by order.
