Article 530 of the French General Tax Code

When the title of a work brought to the mark to the guarantee service or the approved inspection body is found to be lower than the declared legal title, a new test may be carried out if the owner so requests.

When the new test confirms the result of the first, the work is, at the owner’s choice, either returned to the owner after being broken in his presence, or marked with the titre found during the test if it corresponds to one of the legal titres.

In all cases, the owner also has the option of exporting his works in accordance with the provisions of Article 545 (1).

Lorsque le titre d’un ouvrage apporté à la marque au service de la garantie ou à l’organisme de contrôle agréé est trouvé inférieur au titre légal déclaré, il peut être procédé à un nouvel essai si le propriétaire le demande.

Lorsque le nouvel essai confirme le résultat du premier, l’ouvrage est, au choix du propriétaire, soit remis à ce dernier après avoir été rompu en sa présence, soit marqué au titre constaté lors de l’essai s’il correspond à l’un des titres légaux.

Dans tous les cas, le propriétaire dispose également de la possibilité d’exporter ses ouvrages conformément aux dispositions de l’article 545 (1).
