Such decisions shall be declared null and void where they are not given by the prescribed number of judges or where they have been given by judges who did not attend all the hearings in the case. Where several hearings have been devoted to the same case, the judges who contributed to the decision are presumed to have attended all those hearings.
These decisions are also declared null and void when they have been handed down without the public prosecutor having been heard.
Decisions are also declared null and void if, subject to the exceptions provided for by law, they have not been handed down or the proceedings have not been held in open court.
