Article 609 of the French Code of Criminal Procedure

When the Cour de cassation quashes a judgment or ruling handed down in a criminal or police matter, it shall refer the proceedings and the parties back to a court of the same order and degree as the one that handed down the quashed decision.

Lorsque la Cour de cassation annule un arrêt ou un jugement rendu en matière correctionnelle ou de police, elle renvoie le procès et les parties devant une juridiction de même ordre et degré que celle qui a rendu la décision annulée.
