Article 621 of the French Code of civil procedure

If the appeal in cassation is dismissed, the party who lodged it is no longer eligible to lodge a new appeal against the same judgment, except in the case provided for in Article 618.

The same applies when the Cour de cassation declares that it has lost jurisdiction, declares the appeal inadmissible or declares that the appeal has lapsed.

A defendant who has not lodged a cross-appeal or an appeal against the contested judgment within the time limits laid down by Article 1010 is no longer eligible to lodge a main appeal against that judgment.

Article 621

Si le pourvoi en cassation est rejeté, la partie qui l’a formé n’est plus recevable à en former un nouveau contre le même jugement, hors le cas prévu à l’article 618.

Il en est de même lorsque la Cour de cassation constate son dessaisissement, déclare le pourvoi irrecevable ou prononce la déchéance.

Le défendeur qui n’a pas formé de pourvoi incident ou provoqué contre le jugement attaqué dans les délais impartis par l’article 1010 n’est plus recevable à se pourvoir à titre principal contre ce jugement.
