Article 624-2 of the French Code of Criminal Procedure

When an application for review is referred to the committee investigating applications for review and reconsideration pursuant to Article 622, it shall take into account all new facts or unknown elements on which one or more applications previously submitted may have been based and shall refer to the judgment formation of the Court of Revision and Reconsideration applications for which it considers that a new fact has occurred or that an element unknown on the day of the trial has come to light.

When new information reveals that a third party may have been involved in the commission of the acts, the Commission will immediately notify the competent public prosecutor, who will carry out the necessary investigations and may open a judicial inquiry, which may not be entrusted to a judge who has already heard the case. The public prosecutor or examining magistrate may not refer the case to a criminal investigation department or officer who took part in the investigation that led to the applicant’s conviction.

Lorsque la commission d’instruction des demandes en révision et en réexamen est saisie d’une demande en révision en application de l’article 622, elle prend en compte l’ensemble des faits nouveaux ou des éléments inconnus sur lesquels ont pu s’appuyer une ou des requêtes précédemment présentées et saisit la formation de jugement de la cour de révision et de réexamen des demandes pour lesquelles elle estime qu’un fait nouveau s’est produit ou qu’un élément inconnu au jour du procès s’est révélé.

Lorsque les éléments nouveaux laissent apparaître qu’un tiers pourrait être impliqué dans la commission des faits, la commission en avise sans délai le procureur de la République compétent, qui effectue les investigations nécessaires et peut ouvrir une information judiciaire, laquelle ne peut être confiée à un magistrat ayant déjà connu de l’affaire. Le procureur de la République ou le juge d’instruction ne peut saisir un service ou un officier de police judiciaire ayant participé à l’enquête à l’origine de la condamnation du demandeur.
