Article 627-20 of the French Code of Criminal Procedure

If the sentenced person applies for work release, semi-liberty, reduction of sentence, splitting or suspension of sentence, home detention under electronic monitoring or conditional release, the application is sent to the public prosecutor at the court of appeal in whose jurisdiction the person is incarcerated, who forwards it to the Minister of Justice.

The latter forwards the request to the International Criminal Court as soon as possible, together with all relevant documents.

The International Criminal Court decides whether or not the convicted person may benefit from the measure in question. Where the court’s decision is negative, the Government shall inform the court whether it agrees to keep the sentenced person on the territory of the Republic or whether it intends to request his or her transfer to another State designated by the court.

Si la personne condamnée dépose une demande de placement à l’extérieur, de semi-liberté, de réduction de peine, de fractionnement ou de suspension de peine, de détention à domicile sous surveillance électronique ou de libération conditionnelle, sa requête est adressée au procureur général près la cour d’appel dans le ressort de laquelle elle est incarcérée qui la transmet au ministre de la justice.

Celui-ci communique la requête à la Cour pénale internationale dans les meilleurs délais, avec tous les documents pertinents.

La Cour pénale internationale décide si la personne condamnée peut ou non bénéficier de la mesure considérée. Lorsque la décision de la cour est négative, le Gouvernement indique à la cour s’il accepte de garder la personne condamnée sur le territoire de la République ou s’il entend demander son transfert dans un autre Etat qu’elle aura désigné.
