Article 627-7 of the French Code of Criminal Procedure

The proceedings are immediately referred to the Investigating Chamber. The person claimed shall appear before it within eight days of being presented to the Public Prosecutor. At the request of the Public Prosecutor or the person claimed, an additional eight days may be granted before the hearing. An examination is then conducted, of which a report is drawn up.

The hearings take place and the judgment is handed down in open court, unless publicity is likely to prejudice the proper conduct of the proceedings in progress, the interests of a third party or the dignity of the person. In this case, the Investigating Chamber, at the request of the Public Prosecutor, the person claimed or of its own motion, shall give a ruling in chambers which may only be appealed to the Supreme Court at the same time as the ruling on the surrender provided for in article 627-8.

The public prosecutor and the person claimed shall be heard, the latter assisted, if necessary, by his lawyer and, if necessary, in the presence of an interpreter.

La chambre de l’instruction est immédiatement saisie de la procédure. La personne réclamée comparaît devant elle dans un délai de huit jours à compter de sa présentation au procureur général. Sur la demande de ce dernier ou de la personne réclamée, un délai supplémentaire de huit jours peut être accordé avant les débats. Il est ensuite procédé à un interrogatoire, dont il est dressé procès-verbal.

Les débats se déroulent et l’arrêt est rendu en audience publique, sauf si la publicité est de nature à nuire au bon déroulement de la procédure en cours, aux intérêts d’un tiers ou à la dignité de la personne. Dans ce cas, la chambre de l’instruction, à la demande du ministère public, de la personne réclamée ou d’office, statue par un arrêt rendu en chambre du conseil qui n’est susceptible de pourvoi en cassation qu’en même temps que l’arrêt portant sur la remise prévue à l’article 627-8.

Le ministère public et la personne réclamée sont entendus, cette dernière assistée, le cas échéant, de son avocat et, s’il y a lieu, en présence d’un interprète.
