When it appears to the investigating judge in Paris that the acts referred to him do not constitute one of the offences falling within the scope of Article 628 and do not fall within its jurisdiction in any other respect, this magistrate declares that he has no jurisdiction either at the request of the Anti-Terrorism Public Prosecutor or, after receiving the latter’s opinion, of his own motion or at the request of the parties. Any parties who have not submitted an application shall be notified in advance and invited to make their observations known; the order shall be made at the earliest eight days after this notification.
The second paragraph of Article 628-2 shall apply to the order by which the Paris investigating judge declares that he does not have jurisdiction.
As soon as the order has become final, the anti-terrorist public prosecutor shall send the case file to the public prosecutor with territorial jurisdiction.
This article shall apply when the investigating chamber of the Paris court of appeal rules on its jurisdiction.
