Article 665-1 of the French Code of Criminal Procedure

Referral may also be ordered by the Criminal Division if the court normally having jurisdiction cannot be legally composed or if the course of justice is otherwise interrupted.

The motion for referral may be presented either by the public prosecutor at the Cour de cassation or by the public prosecutor established at the court seised.

The motion must be served on all interested parties, who have a period of ten days in which to file a brief with the registry of the Court of Cassation.

The Criminal Division rules within fifteen days of the motion.

Le renvoi peut encore être ordonné par la chambre criminelle si la juridiction normalement compétente ne peut être légalement composée ou si le cours de la justice se trouve autrement interrompu.

La requête aux fins de renvoi peut être présentée, soit par le procureur général près la Cour de cassation, soit par le ministère public établi près la juridiction saisie.

La requête doit être signifiée à toutes les parties intéressées qui ont un délai de dix jours pour déposer un mémoire au greffe de la Cour de cassation.

La chambre criminelle statue dans les quinze jours de la requête.
