Where the investigative decision relates to acts that can only be ordered or carried out in the course of a preparatory investigation, or that can only be carried out in the course of an investigation with the authorisation of the liberty and custody judge, the investigative decision is recognised by the investigating judge, and is carried out by that judge or by officers or agents of the judicial police acting on his letter rogatory.
In other cases, the decision to conduct an investigation is recognised by the public prosecutor and is executed by this magistrate or by the officers or agents of the judicial police required by him for this purpose.
If the magistrate to whom the matter is referred does not have jurisdiction, he shall without delay forward the investigation decision to the competent public prosecutor or investigating magistrate and shall immediately inform the issuing State thereof.
