Article 694-40 of the French Code of Criminal Procedure

If, in the course of executing the investigation decision, the investigating magistrate deems it appropriate to initiate investigative measures not initially planned or which could not be specified when the European investigation decision was issued, he or she shall inform the issuing authority without delay so that it can request new measures if necessary.

Si, en cours d’exécution de la décision d’enquête, le magistrat saisi juge opportun de diligenter des mesures d’enquête non prévues initialement ou qui n’avaient pas pu être spécifiées au moment de l’émission de la décision d’enquête européenne, il en informe sans délai l’autorité d’émission afin qu’elle puisse le cas échéant demander de nouvelles mesures.
