Article 694-46 of the French Code of Criminal Procedure

Where an investigative decision is requested to provisionally prevent the destruction, transformation, moving, transfer or disposal of items likely to be used as evidence, the magistrate shall give his decision as soon as possible and, if possible, within twenty-four hours of receiving it.

Where the issuing authority requests, in the decision, that the items seized pursuant to the first paragraph be transferred to the issuing State, the provisions of Article 694-42 shall apply.

Where the issuing authority requests, in the decision, that the items seized pursuant to the first paragraph be kept on national territory until a date that it sets, the judge hearing the case may determine the conditions under which these items are kept. If, in accordance with these conditions, he or she intends to lift the provisional measure, he or she shall inform the issuing authority so that it may comment.

Lorsqu’il est saisi d’une décision d’enquête visant à empêcher provisoirement toute opération de destruction, de transformation, de déplacement, de transfert ou d’aliénation d’éléments susceptibles d’être utilisés comme preuve, le magistrat rend sa décision dans les meilleurs délais et, si possible, dans les vingt-quatre heures suivant sa réception.


Lorsque l’autorité d’émission demande, dans la décision, que les éléments saisis en application du premier alinéa soient transférés vers l’Etat d’émission, les dispositions de l’article 694-42 sont applicables.


Lorsque l’autorité d’émission demande, dans la décision, que les éléments saisis en application du premier alinéa soient conservés sur le territoire national jusqu’à une date qu’elle fixe, le magistrat saisi peut déterminer à quelles conditions ces éléments sont conservés. Si, conformément à ces conditions, il envisage de lever la mesure provisoire, il en informe l’autorité d’émission afin qu’elle puisse formuler des observations.
