Article 694-47 of the French Code of Criminal Procedure

Where the issuing State requests, under a European Investigation Order, the implementation of an undercover measure on national territory, the terms and conditions of the measure relating to the duration of the undercover measure, its precise terms and conditions or the legal status of the undercover agents shall be determined by mutual agreement between the magistrate to whom the matter is referred and the competent authority of the issuing State.

Failing agreement, the magistrate hearing the case may, without prejudice to the provisions of Article 694-31, refuse to execute the request.

Lorsque l’Etat d’émission sollicite, au titre d’une décision d’enquête européenne, la mise en place d’une mesure d’infiltration sur le territoire national, les modalités de la mesure portant sur la durée de l’infiltration, ses modalités précises ou le statut juridique des agents infiltrés sont fixées d’un commun accord par le magistrat saisi et l’autorité compétente de l’Etat d’émission.


A défaut d’accord, le magistrat saisi peut, sans préjudice des dispositions de l’article 694-31, refuser l’exécution de la demande.
