Article 694-5 of the French Code of Criminal Procedure

The provisions of Article 706-71 shall apply to the simultaneous execution, on the territory of the Republic and abroad, of requests for mutual assistance from foreign judicial authorities or acts of mutual assistance carried out at the request of French judicial authorities.

Interrogations, hearings or confrontations carried out abroad at the request of the French judicial authorities shall be carried out in accordance with the provisions of this Code, unless an international agreement prevents this.

The questioning or confrontation of a person being prosecuted may only be carried out with his or her consent.

The provisions of articles 434-13 and 434-15-1 of the Penal Code shall apply to witnesses heard on the territory of the Republic at the request of the judicial authorities of the requesting State under the conditions set out in this article.

Les dispositions de l’article 706-71 sont applicables pour l’exécution simultanée, sur le territoire de la République et à l’étranger, de demandes d’entraide émanant des autorités judiciaires étrangères ou d’actes d’entraide réalisés à la demande des autorités judiciaires françaises.

Les interrogatoires, les auditions ou les confrontations réalisés à l’étranger à la demande des autorités judiciaires françaises sont exécutés conformément aux dispositions du présent code, sauf si une convention internationale y fait obstacle.

L’interrogatoire ou la confrontation d’une personne poursuivie ne peut être effectué qu’avec son consentement.

Les dispositions des articles 434-13 et 434-15-1 du code pénal sont applicables aux témoins entendus sur le territoire de la République à la demande des autorités judiciaires de l’Etat requérant dans les conditions prévues par le présent article.
