Article 695-12 of the French Code of Criminal Procedure

The offences which may give rise to the issue of a European arrest warrant are, under the law of the issuing Member State, the following:

1° Offences punishable by deprivation of liberty for a period equal to or exceeding one year or, where a sentence has been passed, where the sentence passed is equal to or exceeds four months’ imprisonment;

2° Offences punishable by a detention order for a period equal to or exceeding one year or, where a detention order has been passed, where the period to be served is equal to or exceeds four months’ deprivation of liberty.

Les faits qui peuvent donner lieu à l’émission d’un mandat d’arrêt européen sont, aux termes de la loi de l’Etat membre d’émission, les suivants :

1° Les faits punis d’une peine privative de liberté d’une durée égale ou supérieure à un an ou, lorsqu’une condamnation à une peine est intervenue, quand la peine prononcée est égale ou supérieure à quatre mois d’emprisonnement ;

2° Les faits punis d’une mesure de sûreté privative de liberté d’une durée égale ou supérieure à un an ou, lorsqu’une mesure de sûreté a été infligée, quand la durée à subir est égale ou supérieure à quatre mois de privation de liberté.
