Article 695-26 of the French Code of Criminal Procedure

If the requested person is in a known place on national territory, the arrest warrant issued by a Member State of the European Union or a State linked to the European Union by an agreement mentioned in section 5 of this chapter may be sent directly, in the original or in a certified copy, by any means that leaves a written trace, to the Public Prosecutor with territorial jurisdiction, who shall execute it after ensuring that the request is in order. In other cases, the European arrest warrant shall be executed in the light of the transmission made under the conditions provided for in the second paragraph of Article 695-15.

Articles 74-2 and 230-33 are applicable to the search for a person who is the subject of a European arrest warrant. The powers of the public prosecutor and the liberty and custody judge are then exercised respectively by the public prosecutor and the president of the investigating chamber or the adviser designated by him.

If the Public Prosecutor to whom a European arrest warrant has been addressed considers that he is not territorially competent to act on it, he shall forward it to the Public Prosecutor territorially competent and shall inform the judicial authority of the issuing Member State accordingly.

The original referred to in the last paragraph of Article 695-15 or the certified copy must arrive no later than six working days after the date of arrest of the wanted person.

In the event that the wanted person benefits from a privilege or immunity in France, the Public Prosecutor with territorial jurisdiction shall request the lifting thereof without delay from the competent French authorities. If the French authorities are not competent, the request for waiver is left to the judicial authority of the issuing Member State.

In the event that the wanted person has already been surrendered to France on an extradition basis by another State under the protection conferred by the principle of speciality, the Public Prosecutor with territorial jurisdiction shall take all necessary measures to ensure the consent of that State.

Dans le cas où la personne recherchée se trouve en un lieu connu sur le territoire national, le mandat d’arrêt émanant d’un Etat membre de l’Union européenne ou d’un Etat lié à l’Union européenne par un accord mentionné à la section 5 du présent chapitre peut être adressé directement, en original ou en copie certifiée conforme, par tout moyen laissant une trace écrite, au procureur général territorialement compétent qui l’exécute après s’être assuré de la régularité de la requête. Dans les autres cas, le mandat d’arrêt européen est exécuté au vu de la transmission effectuée dans les conditions prévues au deuxième alinéa de l’article 695-15.

Les articles 74-2 et 230-33 sont applicables à la recherche d’une personne faisant l’objet d’un mandat d’arrêt européen. Les attributions du procureur de la République et du juge des libertés et de la détention sont alors respectivement exercées par le procureur général et le président de la chambre de l’instruction ou le conseiller par lui désigné.

Si le procureur général auquel un mandat d’arrêt européen a été adressé estime qu’il n’est pas territorialement compétent pour y donner suite, il le transmet au procureur général territorialement compétent et en informe l’autorité judiciaire de l’Etat membre d’émission.

L’original mentionné au dernier alinéa de l’article 695-15 ou la copie certifiée conforme doit parvenir au plus tard six jours ouvrables après la date de l’arrestation de la personne recherchée.

Dans le cas où la personne recherchée bénéficie d’un privilège ou d’une immunité en France, le procureur général territorialement compétent en demande sans délai la levée aux autorités françaises compétentes. Si les autorités françaises ne sont pas compétentes, la demande de levée est laissée aux soins de l’autorité judiciaire de l’Etat membre d’émission.

Dans le cas où la personne recherchée a déjà été remise à la France à titre extraditionnel par un autre Etat sous la protection conférée par le principe de spécialité, le procureur général territorialement compétent prend toutes les mesures nécessaires pour s’assurer du consentement de cet Etat.
