Article 695-43 of the French Code of Criminal Procedure

Where, in specific cases and in particular if, following an appeal in cassation, the final decision on the execution of the European arrest warrant cannot be given by the competent judicial authorities within sixty days of the arrest of the requested person, the Public Prosecutor with territorial jurisdiction shall immediately inform the judicial authority of the issuing Member State, giving the reasons for the delay. This period shall then be extended by a further thirty days.

Where, in exceptional circumstances, in particular after a judgment of cassation with referral, the final decision on the execution of the European arrest warrant has not been taken within the period of ninety days from the date of the arrest of the requested person, the Public Prosecutor with territorial jurisdiction shall inform the Minister for Justice, who shall in turn notify Eurojust, stating the reasons for the delay.

After a judgment of cassation with referral, the investigating chamber to which the case is referred rules within twenty days of delivery of the judgment of the Court of Cassation. This chamber hears any applications for release made by the person claimed.

Lorsque, dans des cas spécifiques et en particulier si, consécutivement à un pourvoi en cassation, la décision définitive sur l’exécution du mandat d’arrêt européen ne peut être rendue par les autorités judiciaires compétentes dans le délai de soixante jours à compter de l’arrestation de la personne recherchée, le procureur général territorialement compétent en informe immédiatement l’autorité judiciaire de l’Etat membre d’émission en lui indiquant les raisons du retard. Ce délai est alors prolongé de trente jours supplémentaires.

Lorsque, dans des circonstances exceptionnelles, notamment après un arrêt de cassation avec renvoi, la décision définitive sur l’exécution du mandat d’arrêt européen n’a pas été prise dans le délai de quatre-vingt-dix jours à compter de la date de l’arrestation de la personne recherchée, le procureur général territorialement compétent en informe le ministre de la justice qui, à son tour, en avise Eurojust, en précisant les raisons du retard.

Après un arrêt de cassation avec renvoi, la chambre de l’instruction à laquelle la cause est renvoyée statue dans les vingt jours à compter du prononcé de l’arrêt de la Cour de cassation. Cette chambre connaît des éventuelles demandes de mise en liberté formées par la personne réclamée.
