Where the European arrest warrant has been issued for the purposes of criminal proceedings, the Investigating Chamber shall accede to any request for a hearing of the requested person made by the judicial authority of the issuing Member State.
The requested person may only be heard or questioned, unless he or she expressly waives this, in the presence of his or her lawyer or the latter duly summoned.
The wanted person’s lawyer shall be summoned no later than five working days before the date of the hearing, by registered letter with acknowledgement of receipt, fax with acknowledgement of receipt or orally with a signature in the proceedings file.
The hearing of the person concerned shall be conducted, in the presence of an interpreter if necessary, by the president of the investigating chamber, assisted by a person authorised for this purpose by the judicial authority of the issuing Member State.
The minutes of the hearing, which shall mention these formalities, shall be sent immediately to the judicial authority of the issuing Member State.
