Article 695-6 of the French Code of Criminal Procedure

Where the Public Prosecutor or investigating judge to whom a case has been referred does not comply with a request or opinion from Eurojust, he shall inform Eurojust without undue delay of the decision taken and the reasons for it.

However, such a statement of reasons shall not be compulsory where it may prejudice essential national security interests or jeopardise the success of an ongoing investigation or the safety of a natural person.

Lorsque le procureur général ou le juge d’instruction saisi ne donne pas suite à une demande ou à un avis de l’Agence Eurojust, il l’informe sans retard injustifié de la décision intervenue et de ses motifs.

Toutefois, cette motivation n’est pas obligatoire lorsqu’elle peut porter atteinte à des intérêts nationaux essentiels en matière de sécurité ou compromettre le succès d’une enquête en cours ou la sécurité d’une personne physique.
