Article 695-8-4 of the French Code of Criminal Procedure

As the competent national authority, the national member may receive and transmit, as appropriate, to the competent authorities of the other Member States or to the French judicial authorities any requests made or decisions taken by either of them in the field of judicial cooperation, in particular in application of instruments based on the principle of mutual recognition. It may follow up such requests and decisions and facilitate their execution. When exercising these prerogatives, the national member shall inform the competent judicial authority as soon as possible.

When a request or decision relating to judicial cooperation has been partially or inadequately executed by the French judicial authorities, the national member may ask these authorities to take any additional measures that appear necessary.

En qualité d’autorité nationale compétente, le membre national peut recevoir et transmettre, selon le cas, aux autorités compétentes des autres Etats membres ou aux autorités judiciaires françaises toutes demandes présentées ou toutes décisions prises par les unes ou les autres en matière de coopération judiciaire en application, notamment, d’instruments fondés sur le principe de reconnaissance mutuelle. Il peut assurer le suivi de ces demandes et décisions et en faciliter l’exécution. Lorsqu’il fait usage de ces prérogatives, le membre national en avise dans les plus brefs délais l’autorité judiciaire compétente.


Lorsqu’une demande ou une décision en matière de coopération judiciaire a fait l’objet, de la part des autorités judiciaires françaises, d’une exécution partielle ou insuffisante, le membre national peut demander à ces autorités l’accomplissement des mesures complémentaires qui lui paraissent nécessaires.
