Article 695-9-30-1 of the French Code of Criminal Procedure

For the application of Regulation (EU) 2018/1805 of the European Parliament and of the Council of 14 November 2018 on the mutual recognition of freezing orders and confiscation orders, the competent authorities referred to in Article 2(8) and (9) of that Regulation are as follows:

1° The authorities issuing freezing orders are the public prosecutor, the investigating courts, the liberty and custody judge and the trial courts competent under this Code;

2° The authority responsible for enforcing freezing orders issued by the courts of another Member State of the European Union is the territorially competent investigating magistrate, where applicable via the public prosecutor or the public prosecutor’s office. The examining magistrate with territorial jurisdiction is the magistrate in the place where one of the frozen assets is located or, failing that, the examining magistrate in Paris.

Pour l’application du règlement (UE) 2018/1805 du Parlement européen et du Conseil du 14 novembre 2018 concernant la reconnaissance mutuelle des décisions de gel et des décisions de confiscation, les autorités compétentes mentionnées aux 8 et 9 de l’article 2 du même règlement sont les suivantes :

1° Les autorités d’émission des décisions de gel sont le procureur de la République, les juridictions d’instruction, le juge des libertés et de la détention et les juridictions de jugement compétents en application du présent code ;

2° L’autorité d’exécution des décisions de gel prises par les juridictions d’un autre Etat membre de l’Union européenne est le juge d’instruction territorialement compétent, le cas échéant par l’intermédiaire du procureur de la République ou du procureur général. Le juge d’instruction territorialement compétent est celui du lieu où se situe l’un des biens gelés ou, à défaut, le juge d’instruction de Paris.
