For the application of Regulation (EU) 2018/1805 of the European Parliament and of the Council of 14 November 2018 on the mutual recognition of freezing orders and confiscation orders, the competent authorities referred to in Article 2(8) and (9) of that Regulation are as follows:
1° The authorities issuing freezing orders are the public prosecutor, the investigating courts, the liberty and custody judge and the trial courts competent under this Code;
2° The authority responsible for enforcing freezing orders issued by the courts of another Member State of the European Union is the territorially competent investigating magistrate, where applicable via the public prosecutor or the public prosecutor’s office. The examining magistrate with territorial jurisdiction is the magistrate in the place where one of the frozen assets is located or, failing that, the examining magistrate in Paris.
