Article 695-9-38 of the French Code of Criminal Procedure

If there are facts to suggest that information referred to in Article 695-9-31 could be useful to another Member State either in preventing an offence falling within one of the categories listed in Article 694-32 and punishable in France by a custodial sentence of at least three years’ imprisonment, or in order to conduct investigations to establish proof or to track down the perpetrators of such an offence, the service or unit holding this information shall transmit it, without prior request, to the competent services of that State.

Si des faits permettent de penser que des informations mentionnées à l’article 695-9-31 pourraient être utiles à un autre Etat membre soit pour prévenir une infraction entrant dans l’une des catégories énumérées à l’article 694-32 et punie en France d’une peine privative de liberté d’une durée égale ou supérieure à trois ans d’emprisonnement, soit pour conduire les investigations tendant à établir la preuve ou à rechercher les auteurs d’une telle infraction, le service ou l’unité qui détient ces informations les transmet, sans demande préalable, aux services compétents de cet Etat.
