Extradition shall not be granted:
1° Where the person claimed has French nationality, the latter being assessed at the time of the offence for which extradition is requested;
2° Where the crime or offence is of a political nature or where it is clear from the circumstances that extradition is requested for a political purpose;
3° Where the crimes or offences have been committed on the territory of the Republic;
4° Where the crimes or offences, although committed outside the territory of the Republic, have been prosecuted and finally judged there;
5° When, according to the law of the requesting State or French law, the statute of limitations has expired prior to the extradition request, or the statute of limitations has expired prior to the arrest of the person claimed, and in general whenever the public prosecution of the requesting State has been extinguished ;
6° When the act for which extradition has been requested is punishable under the legislation of the requesting State by a penalty or security measure contrary to French public policy;
7° When the person claimed would be tried in the requesting State by a court that does not provide the fundamental guarantees of procedure and protection of the rights of the defence;
8° When the crime or misdemeanour constitutes a military offence under Book III of the Code of Military Justice.
